MEDIATION

What to Expect

Mediation is a process and set of principles designed to manage and resolve disputes between parties. A process by which the parties, with the assistance of an independent mediator, define issues and, through discussion and constructive negotiations, reach a settlement.

I work with parties, their lawyers and other advisors to achieve settlement of disputes to obtain results that the parties can live with. In conducting mediations I apply expertise and knowledge, to achieve an agreed outcome. Persistence, patience and time are the qualities used to reach a positive result.

To achieve settlement takes a lot of time in many cases, but far less than the time taken in the preparation and conduct of trials.

Benefits of Mediation

The benefits of resolving disputes by mediation are many, including:

  • Parties control the process, and the outcome, and thus do not risk having an outcome imposed upon them by a court or tribunal.
  • There is a certainty of outcome.
  • The process is informal.
  • It is quicker and less stressful.
  • Confidentiality is ensured.
  • There are significant savings of both financial and emotional costs of ongoing litigation and trial.
